Terms of Service — Craftingers (Pakistan)

Welcome to Craftingers. The terms “we”, “us” and “our” refer to Craftingers. These Terms of Service (“Terms”) govern your access to and use of our store and website, including all related information, content, features, tools, products and services (collectively, the “Services”). Craftingers is powered by Shopify, which provides technical hosting and ecommerce functionality.
Please read these Terms carefully. By visiting, interacting with or using our Services you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Overview & Acceptance
These Terms, together with any policies referenced herein (for example our Privacy Policy, Return & Refund Policy, Shipping Policy), describe your rights and responsibilities when you use the Services. They also contain important disclaimers and limitations of liability. You confirm that you have the legal capacity to enter into these Terms.
2. Eligibility & Account Access
You represent and warrant that you are at least 18 years old (the age of majority in Pakistan) and legally able to form a binding contract. If you permit a minor to use the Services through your account, you are responsible for their activity.
To use certain features you may be required to register and create an account. You agree to (a) provide accurate, current and complete information, and (b) maintain the confidentiality of your account credentials. You are responsible for all activity under your account and must notify us immediately of any unauthorized use.
3. Our Products & Descriptions
We aim to describe products accurately. However, colours, finishes and product appearance may vary due to device display settings, natural material variations, or photography. Such natural variations and minor cosmetic marks (typical in handcrafted products) are not generally considered defects unless expressly stated otherwise in our product description or return policy.
We reserve the right to change product descriptions, discontinue items, or limit quantities at any time.
4. Orders, Acceptance & Cancellations
Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is accepted only when we send you an order confirmation indicating acceptance.
Payment must be authorised and received before acceptance. If we cancel or change your order we will notify you using the contact details you provided. Cancellation requests made after acceptance may not be possible; please check our Shipping & Return policies.
5. Prices, Taxes & Payment
Prices shown on the Services are in the currency displayed at checkout and exclude shipping, customs, duties, and applicable taxes unless otherwise stated. You are responsible for any import duties or taxes levied by your local customs or tax authorities.
You agree to provide accurate payment information and to pay all amounts due. We may use third-party payment providers (e.g., Shopify Payments, local gateways). We do not store full card numbers on our servers—payment processing is handled by the provider in accordance with their security practices.
6. Shipping, Delivery & Risk of Loss
Shipping times provided are estimates only and not guarantees. We are not liable for delays caused by carriers, customs clearance, force majeure events, or other circumstances beyond our control.
Title and risk of loss for products pass to you when we deliver the products to the carrier for shipment.
7. Returns, Refunds & Replacements
Returns, refunds and replacements are handled in accordance with our Refund & Return Policy. Please review that policy for eligibility, time limits (for example, damage complaints to be made within 3 days of delivery), required evidence (such as unboxing videos), and the process for returns.

8. Intellectual Property
All content on the Services (including text, graphics, logos, images, videos, and software) is owned or licensed by Craftingers or its partners and is protected by intellectual property laws. Except as expressly permitted, you may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content without our prior written permission.
Trademarks, trade names, and logos displayed on the Services are our property or the property of third parties. Use of these marks without permission is prohibited.
9. User Content & Feedback
If you submit reviews, comments, photos, or other content (“User Content”), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and distribute that content for any purpose (including marketing). You represent that you own or have the right to submit the content and that it does not violate any law or third-party rights.
We may moderate, remove or refuse User Content at our discretion.
10. Optional Third-Party Tools & Links
The Services may provide access to third-party tools, services or external websites (including social media and payment providers). These are provided “as is” and we are not responsible for them. Your interactions with third parties are governed by their terms and privacy policies. We encourage you to review those policies before use.
11. Privacy & Data Protection
Our collection and use of personal information are described in our Privacy Policy. Because the Services are hosted on Shopify and use various third-party service providers, your information may be processed or stored outside Pakistan. By using the Services you consent to such transfers in accordance with applicable law.

12. Errors, Inaccuracies & Price Corrections
We attempt to ensure information on the Services is accurate but errors may occur. We reserve the right to correct errors, inaccuracies or omissions and to cancel orders if information provided was incorrect (including product pricing or availability), even after order confirmation.
13. Prohibited Uses
You agree not to use the Services to: (a) violate applicable law; (b) infringe others’ rights; (c) transmit harmful code or malware; (d) spam, phish, scrape or otherwise collect personal information of others without consent; (e) impersonate someone else; or (f) interfere with the operation or security of the Services. We may suspend or terminate accounts that violate these terms.
14. Suspension & Termination
We may suspend or terminate access to the Services, or your account, at any time for conduct we reasonably believe violates these Terms or is harmful to other users, our business, or third parties. Termination will not affect provisions that by their nature should survive (e.g., intellectual property, indemnity, limitation of liability).
15. Disclaimers
EXCEPT AS EXPRESSLY PROVIDED, THE SERVICES, PRODUCTS AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAFTINGERS DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW CERTAIN DISCLAIMERS; THOSE LIMITATIONS APPLY TO YOU.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER CRAFTINGERS NOR ITS AFFILIATES, PARTNERS, OFFICERS OR EMPLOYEES WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY TO YOU FOR DIRECT DAMAGES WILL BE LIMITED TO THE AMOUNT YOU PAID FOR THE RELEVANT PRODUCT(S) GIVING RISE TO THE CLAIM. THESE LIMITATIONS MAY NOT APPLY WHERE PROHIBITED BY LAW.
17. Indemnification
You agree to indemnify and hold Craftingers and its affiliates harmless from any claims, losses, liabilities, damages and expenses (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) your use of the Services.
18. Governing Law & Dispute Resolution
These Terms and any dispute arising from or related to them shall be governed by the laws of the Islamic Republic of Pakistan. You and Craftingers submit to the exclusive jurisdiction of the courts located in the city where Craftingers is headquartered (or, if preferred, the courts of Islamabad), unless otherwise required by applicable law. If you prefer a different jurisdiction clause (for example a provincial court), contact us to discuss—otherwise these terms stand.
19. Severability; Waiver; Entire Agreement
If any provision is found invalid or unenforceable, the remainder of the Terms will remain in force. A failure to enforce any right is not a waiver. These Terms, together with our Privacy Policy and other incorporated policies, constitute the entire agreement between you and Craftingers concerning the Services.
20. Changes to These Terms
We may modify these Terms from time to time. If changes are material we will provide notice as required by law (for example by posting a notice on the website or sending an email). Continued use after changes constitutes acceptance.
